Wills

A Will enables you to set down what you wish to happen to your assets when you die. Wills must be in writing and properly witnessed and there are many strict rules about its contents and the way in which it must be completed.

If you die without a Will, or leave a Will which is incomplete or invalid, the law provides what happens to your estate. If you are married, it does not necessarily follow that the whole of your estate goes to your spouse. “Common Law” partners are not recognised at all. We may also be able to help protect your Will from being contested later.

Failure to make a Will can not only lead to unexpected results, but cause much heartache and unhappiness for those who survive you. There is a great reassurance to setting out your wishes plainly within a Will.

We can advise you on making a Will, as well as advising you upon the opportunities for setting up simple Trusts and other devices to limit potential liability to Inheritance Tax. The appointment of Executors needs to be considered carefully and we can advise on the appropriate family or friends to do this. Where required, the partners of the firm will act as Executors.

In making a Will you need also to consider making specific gifts of individual items and possibly legacies to family or charities. Finally, it is vital to consider how the remainder of your estate is divided and what happens if any of those beneficiaries die before you. We can guide you through the process and it is helpful if you can complete our Will Questionnaire in advance. All cases vary and we will quote according to your particular requirements and circumstances and if trusts or tax planning are required.
