The government has tabled amendments to the Enterprise and Regulatory Reform Bill.
The proposals suggest a wording change in respect of settlement offers. It provides that, subject to exceptions, an offer made or discussion held with an employee with a view to terminating employment cannot then be taken into account in unfair dismissal proceedings. This rule does not apply where there is a complaint of automatic unfair dismissal.
