Landlords – New Section 21 Notice
ATTENTION ALL LANDLORDS – NEW SECTION 21 NOTICE
Important changes came into effect on 1 October 2015 relating to the way Landlord’s obtain possession of their property from Tenants who have an Assured Shorthold Tenancy. Some points to note about the new rules are:-
- A new standardised Section 21 Notice has been introduced. This new form of Notice must be used for all new tenancies created on or after 1 October 2015 or tenancies that are renewed after 1 October 2015. The new Notice does not apply to statutory periodic tenancies that just follow on after 1 October 2015.
- The new Section 21 Notice does not need to end on the last day of a period of a tenancy.
- Possession Proceedings must be issued within six months of serving the new Section 21 Notice otherwise it will lapse.
- For the new Section 21 Notice to be valid, the Tenant must have received at some stage:-
- A valid Energy Performance Certificate
- Current Landlord’s Gas Safety Certificate
- The Government’s How to Rent Book
- The Deposit must be protected in accordance with the Deposit Protection
Rules.
- A Section 21 Notice may not be served in some circumstances where disrepair has been reported.
