New Legal Services Order

Since 1 April 2013 courts can order a party to make a payment to their spouse or civil partner for their legal costs. This is known as a legal services order and has been introduced as part of the Legal Aid, Sentencing and Punishment of Offenders Act 2012. This amends the Matrimonial Clauses Act 1973 and the Civil Partnership Act 2004.
The order will be available to those in divorce/dissolution proceedings and connected financial relief hearings.
The order must not be made unless the court is satisfied that the applicant would not be able to fund the appropriate legal services without it. The court must also be satisfied that the applicant will not reasonably be able to secure a loan or be able to secure a charge over assets recovered in the proceedings.
