Queen’s Speech & Law Society’s Reply

The Law Society released its response to the 2012 Queen’s Speech.  The Speech outlined changes to family law under the Children and Families Bill.

In relation to the government’s proposals for legislation on shared parenting, the Law Society said they should not be misinterpreted as “equal time for each parent” and that the welfare of the child must be paramount when any arrangements are made.  The Society is concerned that such an interpretation might lead to “a focus on the rights of parents over the rights of children, and an assumption that the starting point is “equal time”.  Unfortunately this is only likely to entrench attitudes among litigating parents.  What is really needed is a more thoughtful approach to what parental responsibility means post-separation.”
