In the case of Mba v Mayor and Burgesses of the London Borough of Merton, the EAT upheld a ruling that a Christian care worker was not indirectly discriminated against by having to work on a Sunday.

The employee held a strong belief that Sunday was a day of rest.  The children’s care home she worked for required all staff to work some Sundays.  The tribunal ruled that this was reasonable in the home’s aim of appropriate staffing and continuity in the care of the children.
