Flat Owners – Buying The Freehold of Your Building

There can be many advantages for you and the other flat owners in your building in collectively owning the freehold of your building. Including the ability to extend and vary the leases of the flats. As well as having control over the management of the building.

Can you force your landlord to sell the freehold?

Many groups of flat owners have the right to collectively buy the freehold (or Head Lease) of their building.  We can advise you whether you qualify, explain your rights and guide you through the procedure.

Does your landlord want to sell the freehold to a third party?

Do you own a leasehold flat and your landlord is selling the freehold (or Head Lease) in the building? You and the other flat owners may (subject to satisfying the qualifying criteria) be entitled to collectively purchase your landlord’s interest on the same terms as your Landlord is offering it to a third party.

In these circumstances your Landlord is obliged to serve a Notice on you and the other flat owners informing you of the proposed terms of the sale. Offering the freehold (or Head Lease) to you on the same terms.  If your Landlord fails to comply with this duty, the flat owners are entitled to collectively purchase the building from the third party buyer. These can be on the same terms as the third party buyer who purchased it.

Have you received a Notice from your Landlord or believe your Landlord has sold their interest without notifying the flat owners? If so, please contact us immediately in order that we can assess whether a Notice should have been served and advise you of your rights.

This right also applies (subject to satisfying the qualifying criteria) if your Landlord is selling or leasing part or all of the communal areas in your building. We can advise you on your rights.
