Divorce Procedure
Once the Court has issued your Divorce Application there will be a minimum timeframe of 20 weeks between the issue of the Divorce Application and the Conditional Order of Divorce. This period is to give couples a time for reflection. This period can also be used to agree finances.
You can apply for the Final Order of Divorce 6 weeks after the Conditional Order of Divorce is pronounced although parties are often advised to hold off on applying for the Final Order of Divorce until the finances are resolved.

Applications
Both before and during Divorce proceedings, matters may arise which require a party to make a specific Application to the Court. The types of Applications that can be made are:
- Application to amend Divorce Application.
- Application to proceed without original Marriage Certificate.
- Application to withdraw Divorce Application.
- Application to expedite Divorce proceedings where special reasons (shorten or remove the 20 week holding period between the Divorce Application and Conditional Order of Divorce or the 6 week period between the Conditional Order of Divorce and Final Order of Divorce).
- Application for Costs.
- Application to extend the time for Service.
- Application for disclosure of the Respondent’s address.
- Application for a Final Order of Divorce where you are the Respondent in the Divorce proceedings.
- Application to rescind (cancel) Conditional Order of Divorce or Final Order of Divorce.
- Application to stay (halt) a Conditional Order of Divorce or Final Order of Divorce.
- Application for permission to submit an Answer (dispute) out of time.
- Application for Alternative Service (for permission to serve Respondent by an alternative method).
- Application for Deemed Service (where the Respondent has not submitted a Divorce Response).
- Application to Dispense Service (where all attempts to serve the Respondent have failed).
