Related cases heard at The High Court this year have demonstrated the powers of the court to alter financial arrangements between a husband and a wife.

In these cases the court set aside a husband’s business transaction, ruled that a decision to pay lump sums to directors had no valid justification and ruled that shares be transferred to the wife if the sale of the business fell through.

During divorce proceedings any decision in relation to a business must be justified as the court may add back any money that has been disposed of in an effort to defeat the financial claim of the other party.  The respondent must show that this was not their intention.
