Finances – Errors with the court Form E

The Justice Secretary has recently discovered an issue in relation to the Form E (Financial Statement) found on the HM Courts and Tribunal Service website (version April 2011 to March 2012).

A Form E is a means of providing your spouse with all information and documentation in respect of your financial circumstances.

It is used in matrimonial proceedings to assist the parties establish the overall assets before negotiating how they should be divided.

It also enables your solicitor to advice you as to an appropriate division of the assets in your circumstances.

It has been confirmed that the Form E found on the HMCTS website contained a fault which meant the summary found at Section 2.20 and 2.21 of the Form E (which should automatically calculate the current value of your assets), calculated the wrong total for an individual’s next assets. This is because it failed to deduct certain liabilities and therefore provided an incorrect overall figure.

The Ministry of Justice has confirmed that the cases affected by this error have been identified.
