Sir Nicholas Wall, President of the Family Division, has expressed his concern over the damage caused to children whose parents are involved in acrimonious court proceedings.
As reported in the Telegraph, Sir Nicholas Wall believes that children are often used as ‘ammunition’ for warring parents which leaves them damaged by the experience. Lawyers are concerned that this problem will only worsen due to cuts in legal aid provision leading to more parents representing themselves at court.
Sir Nicholas Wall has encouraged family judges to become a “case manager” in that they should take the initiative and decide what the child wants and “give directions to ensure that it is obtained”.
