Shared Parenting Proposal
Family and Children
The Department for Education has proposed amendments to the Children Act 1989 to provide a presumption of shared parenting.
The new subsections propose:
- That courts will be required to hold a presumption that the involvement of both parents will be a benefit to the child’s welfare.
- Setting out the restrictions on this presumption, including where a child would be put at risk of suffering harm.
It is intended that these amendments will reinforce the importance of children having contact with both parents when it is safe to do so and in the child’s best interests.
