Important Changes to Financial Provision Under Consideration

A consultation is taking place by The Law Commission looking at the subject of matrimonial property, needs and agreements.

The issues outlined for consultation are in relation to financial provision on divorce or the dissolution of a civil partnership – specifically needs and the scope and legal treatment of non-matrimonial property.

The consultation will look at defining ‘financial needs’ as this is not set out in the statute and therefore the possibility of new legislation in the long term.

The consultation will also look at whether there is a need for principled reform of spousal maintenance and explore why it should be paid, how much should be paid and how long it should be paid for.

The final aspect that will be explored is non matrimonial property.  The consultation seeks to look at its definition in law and the extent to which it should be ring-fenced on divorce or the dissolution of a civil partnership.

The consultation is open until 11 December 2012 and is intended to complement the previous consultation on pre-nuptial agreements.
