Resolution Highlights Flaws in New Mediation Rules

On 6 April 2011 the new Family Procedure Rules 2010 came into force.  Amongst these rules is the need for separating couples to receive mediation before making an application to the court.

The new procedures have been broadly welcomed by Resolution, the family law association, who have a code of conduct designed to resolve cases amicably.  However they believe rushed development has led to flaws in the new rules.  They say that other options including solicitor led negotiation amongst others should form part of non-court options.  Separating families should be able to access information about all the different ways they can resolve their differences, not just mediation.
