Landlord and Tenant – Gas Safety
From 1 January 2013 the technical instructions for Gas Safe registered engineers changed in relation to concealed flues.
The changes recommend that:
- Landlords should fit inspection hatches as soon as possible to enable the inspection of concealed flues. The inspection will ensure that flues are correctly fitted, and safe from dangers such as carbon monoxide leaks.
- Hatches should be at least 300mm square and positioned within 1.5m of any joint in the flue system.
If the engineer cannot view a concealed boiler flue along its length the installation will be classified ‘At Risk’ for the safety of the occupants. The occupants will be formally advised of this by the engineer and the boiler will be turned off with their consent.
A tenant who is advised to turn off a boiler might argue that the landlord is in breach of its repairing covenant or refuse to pay rent.
