Landlord Unable to Recover Insurance Rent

In the case of Green v 180 Archway Road Management Co Ltd [2012] a landlord was unable to recover insurance rent due to failing to insure in joint names. 

The landlord’s insurance policy included a general noting of the Tenant’s interest and had therefore not complied with its insurance obligations under the lease.

Landlords must strictly comply with insurance obligations as set out in the lease or risk being unable to recover the costs from the tenants.
