Reasonable Investigation into Dishonesty

Employment Law – Unfair Dismissal

In the case of Stuart v London City Airport the EAT ruled that a higher threshold was required when undertaking an investigation prior to dismissal.

The case involved a claim of unfair dismissal amid allegations of dishonest conduct.  The EAT ruled that a higher threshold was required in terms of ‘reasonable’ investigation.  Evidence that might clear the employee of blame should be thoroughly explored especially when a serious allegation has been made against them.
